The Constitutional Court said, "It has been clarified that the approval of a majority of the National Assembly members is sufficient when impeaching the prime minister, who is acting as president," adding, "Although the non-appointment of the Constitutional Court justice candidate is a violation of the Constitution, it cannot be concluded that it is a case of betraying the public's trust, so there is no reason to justify the dismissal."
Out of a total of eight judges, acting Chief Justice of the Constitutional Court Moon Hyung-bae and five judges, Lee Mi-sun, Kim Hyung-doo, Jeong Jeong-mi, and Kim Bok-hyung, expressed their opinions. Two judges, Jeong Hyung-sik and Cho Han-chang, expressed their opinions, and only judges from the political line presented their opinions on "citation of impeachment."
Kwon Young-se, chairman of the People's Power Emergency Response Committee, held a press conference and said, "The judiciary left a stern warning against excessive legislative violence by the giant opposition," adding, "The nine losses out of nine are a record defeat that will remain a path in constitutional history." Lee Jae-myung, chairman of the Democratic Party of Korea, criticized the Constitutional Court, saying, "I don't know if the people will understand the ruling that it has not reached the point of impeachment for violating constitutional obligations."
